What A Protective Order Will Do
There are two types of protective orders in Kentucky: an emergency protective order and a domestic violence order. Though both are signed court orders issued by a judge, emergency protective orders are typically short-term protective orders that do not require a full court hearing whereas domestic violence orders are longer term orders that do require a hearing prior to being entered.
Both types of protective orders prevent an aggressor from, among other things:
- Making any contact with the petitioner unless specifically allowed by the court
- Committing further acts of violence or abuse toward the petitioner
- Going within a specified distance of the petitioner, a minor child of the petitioner or other family members
- Destroying, damaging, removing or disposing of any property
If an individual violates the terms of a protective order, that individual may be arrested as a consequence and charged with a crime.
